Update: A sample of UAP legislation
Here’s what some of the states have introduced
Many states have introduced legislation addressing the use of unlicensed assistive personnel. Here is a sample of the legislation and where they stood at the time of publication:
Connecticut:
HB 5390: Regulates unlicensed personnel who assist health care providers. Passed the House and has gone to the Senate.
Indiana:
SCR 63: Urges the establishment of an interim study committee on long-term care certified nurse aide staffing. The Senate Committee on Health and Environmental Affairs advised to pass the legislation.
Maine:
SB 731: An act to provide for assisted living services.
LD 1835: An act to promote choice and quality in long-term care. Amends the nurse practice act to include language that would require nurses to coordinate the oversight of patient care services provided by unlicensed health care assistive personnel. Signed by the governor.
Oklahoma:
SB 537: Defines "advanced unlicensed assistive person" as any person who has successfully completed a training program approved by the Oklahoma Board of Nursing and is certified by the board to function in an assistive role to the licensed nurse in the providing of patient or client care activities, as defined in the rules of the board, providing for certification. Signed by the governor.
